Pioneering Apple Lisa Goes 'Open Source' Thanks To Computer History Museum (arstechnica.com) 81

An anonymous reader quotes a report from Ars Technica: As part of the Apple Lisa's 40th birthday celebrations, the Computer History Museum has released the source code for Lisa OS version 3.1 under an Apple Academic License Agreement. With Apple's blessing, the Pascal source code is available for download from the CHM website after filling out a form. Lisa Office System 3.1 dates back to April 1984, during the early Mac era, and it was the Lisa equivalent of operating systems like macOS and Windows today. The entire source package weighs is about 26MB and consists of over 1,300 commented source files, divided nicely into subfolders that denote code for the main Lisa OS, various included apps, and the Lisa Toolkit development system.

First released on January 19, 1983, the Apple Lisa remains an influential and important machine in Apple's history, pioneering the mouse-based graphical user interface (GUI) that made its way to the Macintosh a year later. Despite its innovations, the Lisa's high price ($9,995 retail, or about $30,300 today) and lack of application support held it back as a platform. A year after its release, the similarly capable Macintosh undercut it dramatically in price. Apple launched a major revision of the Lisa hardware in 1984, then discontinued the platform in 1985. [...] Lisa OS defined important conventions that we still use in windowing OSes today, such as drag-and-drop icons, movable windows, the waste basket, the menu bar, pull-down menus, copy and paste shortcuts, control panels, overlapping windows, and even one-touch automatic system shutdown.

Apple Indefinitely Postpones Launch of AR Glasses (reuters.com) 34

Apple has postponed the launch of its lightweight augmented-reality glasses indefinitely due to technical challenges, but is still planning to unveil its first mixed-reality headset this year, Bloomberg News reported on Tuesday. Reuters reports: The iPhone maker's mixed-reality headset - which combines both augmented and virtual reality -- is set to launch in this year's spring event, Bloomberg said, adding that the device will cost around $3,000. Apple's mixed-reality device would compete with the likes of Meta Platforms' Quest Pro virtual and mixed-reality headset, which it launched late last year for $1,500, half of the Apple device's reported price.

The Cupertino, California-based company now plans to focus on lowering the price of the follow-up version of its mixed-reality device, expected as soon as 2024 or early 2025, instead of working on the AR glasses, according to the report. Apple will aim to do so by using chips on par with those in the iPhone rather than components found in higher-end Mac computers.

Apple Announces a Mac Mini With the M2 and M2 Pro (theverge.com) 73

The Mac Mini is Apple's next computer to get the bump up to the M2 chip -- and this time around, it's being offered with the Pro version of Apple's processor, too. From a report: The new model was announced this morning in a press release, with a starting price of $599, and is available to order today, with availability beginning Tuesday, January 24th. The Mac Mini's baseline configuration includes the M2 chip, 8GB of RAM, and 256GB of storage. It features an HDMI port, Gigabit Ethernet, and a standard headphone jack, alongside two USB-A ports and two Thunderbolt 4 (USB-C) ports -- an upgrade from the Thunderbolt 3 ports on the previous generation.

The M2 Pro configuration of the new Mac Mini features 16GB of RAM, 512GB of SSD storage, and an additional two Thunderbolt 4 ports alongside the ports already available on the standard M2 model. This configuration will set you back $1,299, more than double the price of the baseline model. This is the first time Apple has brought Pro-tier chips to the Mini. The Mini was previously only offered with the entry-level M1 chip -- the same one used in MacBook Air. This time, it's being offered with one of Apple's more powerful chip series. The M2 Max, however, is so far only being offered in the MacBook Pro.

Apple Reportedly Working On Touchscreen Macs, Including MacBook Pro (macrumors.com) 77

Despite years of resistance, Apple is now working on adding touchscreens to Macs, according to a report today from Bloomberg's Mark Gurman. The report claims that a new MacBook Pro with an OLED display could be the first touchscreen Mac in 2025. MacRumors reports: Gurman said Apple engineers are "actively engaged in the project," indicating that the company is "seriously considering" producing touchscreen Macs. The first MacBook Pro with a touchscreen would retain a traditional laptop design with a trackpad and a keyboard, but the display would gain support for touch input like an iPhone or iPad. The first touchscreen Macs are likely to use macOS, as Apple is not actively working to combine iPadOS and macOS, according to the report. iPhone and iPad apps are available on Macs with Apple silicon chips, though, unless a developer opts out.

Apple has repeatedly dismissed the idea of a touchscreen Mac over the years, so this would be a major reversal in philosophy for the company if it moves forward with these plans. In 2010, for example, Steve Jobs said that "touch surfaces don't want to be vertical" due to arm fatigue associated with holding up a finger to the screen. And in 2021, Apple's hardware engineering chief John Ternus said the Mac was "totally optimized for indirect input" and said the company did not feel there was a good reason to change that at the time.

Apple To Begin Making In-House Screens in 2024 in Shift Away From Samsung (bloomberg.com) 30

Apple is planning to start using its own custom displays in mobile devices as early as 2024, an effort to reduce its reliance on technology partners like Samsung and LG and bring more components in-house. From a report: The company aims to begin by swapping out the display in the highest-end Apple Watches by the end of next year, according to people with knowledge of the matter. The screens upgrade the current OLED -- organic light-emitting diode -- standard to a technology called microLED, and Apple plans to eventually bring the displays to other devices, including the iPhone. The changes are part of a sweeping effort to replace Apple supplies with homegrown parts, an undertaking that will give the company more control over the design and capabilities of its products. The tech giant has dropped Intel chips in its Mac computers in favor of in-house designs and plans to do the same with the key wireless components in its iPhones.

Microsoft Scraps Plans For Dual-Screen Surface Duo 3, Pivots To New Foldable Screen Design (windowscentral.com) 25

According to Windows Central's Zac Bowden, Microsoft's next foldable Surface phone will feature "a more traditional foldable design, with a 180-degree hinge, internal foldable screen and external cover display." Bowden writes: I'm told this new foldable device came about after the company had already finalized a dual-screen design for Surface Duo 3. This original dual-screen design was supposed to ship at the end of 2023 as the next Surface Duo, featuring narrower and taller edge-to-edge displays, wireless charging, and other improvements. That dual-screen design has now been scrapped, and the Surface team is now focused on delivering this new "true" foldable design. Microsoft began exploring single-screen foldable designs as a potential successor to the Surface Duo 2 in late 2021 after it launched and was met with mixed reviews.

It's still too early to know the exact specs that this new foldable device is going to feature hardware wise, or whether or not Microsoft plans to simulate a dual-screen experience via a software feature or mode. My sources say there's no concrete shipping window for the device in place yet either, meaning it's unlikely to be ready in time for this fall. [...] Of course, with the change in form factor may also come a change in name. It's still too early to tell, but given this device isn't a traditional Duo in form factor, perhaps the company will take this opportunity to rebrand the line, similar to what it did with the Surface Book and Surface Laptop Studio. Regardless, sources tell me this device is still considered a third-generation Duo internally.
Bowden goes on to say that Microsoft remains "all-in" on delivering its own Android hardware and software. There's a larger software effort ongoing internally that aims to "deliver an ecosystem experience between Microsoft's Android hardware and Windows PCs similar to that between an iPhone and Mac."

The company has also been "exploring different form factors to ship in addition to a foldable device."

Apple's Battery Replacement Prices Are Going Up by $20 To $50 (theverge.com) 55

Apple is raising the price of getting a new battery installed in most iPhones, iPads, and Macs, starting on March 1st. The company made the announcement on the devices' repair pages, in small text under its price estimators. From a report: How much the price hike is depends on what device you have. For iPhones, it's simple -- Apple's site says "the out-of-warranty battery service fee will be increased by $20 for all iPhone models prior to iPhone 14." For phones with a home button, that means the price will be going from $49 to $69, and for Face ID phones that means it'll be going from $69 to $89. Those prices, by the way, were put in place in 2019, after Apple ran a year-long promotion where you could get a new battery for $29, to make up for its battery throttling controversy. For "all MacBook Air models" the price increase will be $30, bringing the price from $129 to $159.

Microsoft's Making Excel's Formulas Even Easier (theverge.com) 47

Microsoft has announced it's making Excel's autocomplete even smarter, at least in the web version that comes with Microsoft 365 (formerly known as Office 365). The Verge reports: Formula suggestions are pretty much what they say on the tin: if you type the equal sign into a cell, Excel for web will try to intelligently suggest what type of formula you should be using, given the data that's around it. For example, if you have a full of quarterly sales numbers and a column at the end labeled "total," Excel might suggest summing the range of cells. According to a blog post from Microsoft, the feature currently only works in English, and will suggest sum, average, count, counta, min, and max formulas. It's not a groundbreaking feature, to be sure -- Google Sheets has had something similar for a while, and Excel's AutoSum has long been a quick way to apply formulas to data -- but for some use cases, it could be a nice timesaver.

Then there's Formula by Example, which is similar to the Flash Fill feature that can automatically detect patterns in data and fill out the rest of a column. The feature is a bit hard to explain succinctly, but this video from Microsoft gives you an idea of what it's about; detecting a pattern where you're combing information from cells and then automatically generating a formula that will save you some typing.

Microsoft's blog post also includes several other feature announcements [...]. There's a function for adding images with alt-text into your tables coming to Windows, Mac, and web, and the company's also adding nested Power Query data types and the ability to get data from dynamic arrays to the Insider version of the Windows app for testing. One other potentially useful (and thankfully easy to understand) feature coming to the web is "suggested links," which will automatically help you fix broken links to other workbooks stored in the cloud.

Mozilla Just Fixed an 18-Year-Old Firefox Bug (howtogeek.com) 61

Mozilla recently fixed a bug that was first reported 18 years ago in Firebox 1.0, reports How-to Geek: Bug 290125 was first reported on April 12, 2005, only a few days before the release of Firefox 1.0.3, and outlined an issue with how Firefox rendered text with the ::first-letter CSS pseudo-element. The author said, "when floating left a :first-letter (to produce a dropcap), Gecko ignores any declared line-height and inherits the line-height of the parent box. [...] Both Opera 7.5+ and Safari 1.0+ correctly handle this."

The initial problem was that the Mac version of Firefox handled line heights differently than Firefox on other platforms, which was fixed in time for Firefox 3.0 in 2007. The issue was then re-opened in 2014, when it was decided in a CSS Working Group meeting that Firefox's special handling of line heights didn't meet CSS specifications and was causing compatibility problems. It led to some sites with a large first letter in blocks of text, like The Verge and The Guardian, render incorrectly in Firefox compared to other browsers.

The issue was still marked as low priority, so progress continued slowly, until it was finally marked as fixed on December 20, 2022. Firefox 110 should include the updated code, which is expected to roll out to everyone in February 2023.

Apple's Self-Service Repairs Expand To Desktops Like iMac, Mac Studio (arstechnica.com) 5

An anonymous reader quotes a report from Ars Technica: Apple's Self Service Repair program continues to roll out in new regions and to new products. Earlier this month, the program expanded from the United States to eight European countries. Now, US customers are gaining access to manuals and parts for new devices: Mac desktops. As reported first by Six Colors, the program has now been extended to cover the Mac Studio, M1 Mac mini, M1 iMac, and the Studio Display.

Up until now, it only covered the M1 MacBook Air, M1 MacBook Pro, the iPhone SE, and iPhone 12 and 13 models. This expansion only applies in the US, though; the previously mentioned European countries will have to wait to gain coverage of these additional devices, it seems. iPhone or Mac owners can go to Apple's website to buy or rent repair kits, including parts and manuals, to perform repairs themselves rather than take their devices to the Apple Store or a repair shop.
Apple's Self Service Repair first launched in the United States in April, with an initial focus on the iPhone.

Apple Scales Back High-End Mac Pro Plans, Weighs Production Move To Asia (bloomberg.com) 33

An anonymous reader quotes a report from Bloomberg, written by Mark Gurman: The new high-end Mac Pro with Apple silicon is behind schedule, and you can blame changes to the company's chip and manufacturing plans. When Apple announced plans in June 2020 to transition away from Intel processors to Mac chips designed in-house, the company said the move would take about two years. Now at the tail end of 2022, it's clear that Apple has missed its self-imposed deadline for completing the shift. In addition to not offering a Mac Pro with Apple silicon, the company still only sells the high-end version of the Mac mini desktop in an Intel flavor. While Apple has said little to nothing about its future Mac desktops or the reasons behind the holdup, the company continues to actively test an all-new Mac Pro and an M2 Pro-based Mac mini to replace the remaining Intel models. Apple had aimed to introduce the new Mac Pro by now, but the high-end machine has been held up for a number of reasons, including multiple changes to its features, a significant shift in the company's plans for high-end processors and a potential relocation of its manufacturing.

When Apple first set out to build a replacement for the Intel Mac Pro, it planned a machine with a processor based on the original M1 chip. The approach called for two main configurations: one chip equal to the power of two M1 Max processors -- the highest-end MacBook Pro chip -- and another equal to four M1 Max components combined. The dual M1 Max chip ended up first launching in the Mac Studio as the M1 Ultra, and Apple decided to push back the Mac Pro to the M2 generation. The company then planned for the Mac Pro to come in two configurations: an M2 Ultra version and a double-M2 Ultra that I've dubbed the "M2 Extreme." The M2 Ultra chip is destined to have some serious specifications for professional users, including up to 24 CPU cores, 76 graphics cores and the ability to top out the machine with at least 192 gigabytes of memory. An M2 Extreme chip would have doubled that to 48 CPU cores and 152 graphics cores. But here's the bad news: The company has likely scrapped that higher-end configuration, which may disappoint Apple's most demanding users -- the photographers, editors and programmers who prize that kind of computing power.

The company made the decision because of both the complexity and cost of producing a processor that is essentially four M2 Max chips fused together. It also will help Apple and partner Taiwan Semiconductor Manufacturing Co. save chip-production resources for higher-volume machines. Moreover, there are concerns about how much consumers are willing to spend. Using the highest-end M1 Ultra chip pushes the Mac Studio up to $5,000 -- only $1,000 less than the current Mac Pro. That's $3,000 more than the M1 Max Mac Studio. Based on Apple's current pricing structure, an M2 Extreme version of a Mac Pro would probably cost at least $10,000 -- without any other upgrades -- making it an extraordinarily niche product that likely isn't worth the development costs, engineering resources and production bandwidth it would require. Instead, the Mac Pro is expected to rely on a new-generation M2 Ultra chip (rather than the M1 Ultra) and will retain one of its hallmark features: easy expandability for additional memory, storage and other components.
Gurman says the Mac Mini update "will come in regular M2 and M2 Pro variations, while new 14-inch and 16-inch MacBook Pros are arriving early next year with M2 Pro and M2 Max options." A high-end iMac Pro with Apple silicon is also in the works, "but that machine has suffered internal delays for similar reasons as the Mac Pro," he notes.

In addition, Gurman says Apple is "working on multiple new external monitors [...], including an update to the Pro Display XDR that was launching alongside the Intel Mac Pro in 2019." The new monitors will also include Apple silicon.

OSnews Decries 'The Mass Extinction of Unix Workstations' (osnews.com) 284

Anyone remember the high-end commercial UNIX workstations from a few decades ago — like from companies like IBM, DEC, SGI, and Sun Microsystems?

Today OSnews looked back — but also explored what happens when you try to buy one today> : As x86 became ever more powerful and versatile, and with the rise of Linux as a capable UNIX replacement and the adoption of the NT-based versions of Windows, the days of the UNIX workstations were numbered. A few years into the new millennium, virtually all traditional UNIX vendors had ended production of their workstations and in some cases even their associated architectures, with a lacklustre collective effort to move over to Intel's Itanium — which didn't exactly go anywhere and is now nothing more than a sour footnote in computing history.

Approaching roughly 2010, all the UNIX workstations had disappeared.... and by now, they're all pretty much dead (save for Solaris). Users and industries moved on to x86 on the hardware side, and Linux, Windows, and in some cases, Mac OS X on the software side.... Over the past few years, I have come to learn that If you want to get into buying, using, and learning from UNIX workstations today, you'll run into various problems which can roughly be filed into three main categories: hardware availability, operating system availability, and third party software availability.

Their article details their own attempts to buy one over the years, ultimately concluding the experience "left me bitter and frustrated that so much knowledge — in the form of documentation, software, tutorials, drivers, and so on — is disappearing before our very eyes." Shortsightedness and disinterest in their own heritage by corporations, big and small, is destroying entire swaths of software, and as more years pass by, it will get ever harder to get any of these things back up and running.... As for all the third-party software — well, I'm afraid it's too late for that already. Chasing down the rightsholders is already an incredibly difficult task, and even if you do find them, they are probably not interested in helping you, and even if by some miracle they are, they most likely no longer even have the ability to generate the required licenses or release versions with the licensing ripped out. Stuff like Pro/ENGINEER and SoftWindows for UNIX are most likely gone forever....

Software is dying off at an alarming rate, and I fear there's no turning the tide of this mass extinction.

The article also wonders why companies like HPE don't just "dump some ISO files" onto an FTP server, along with patch depots and documentation. "This stuff has no commercial value, they're not losing any sales, and it will barely affect their bottom line.

Judge Approves Apple's Massive MacBook Keyboard Lawsuit Payout (mactrast.com) 21

A California federal judge has given preliminary approval to Apple's plan to pay $50 million to settle a long-running class-action lawsuit over the faulty MacBook butterfly keyboard. MacTrast reports: Law360 says the payment will include $13.6 million in attorney fees, up to $2 million in litigation costs, and $1.4 million in settlement administration costs, with the rest distributed to class members. The lawsuit covers customers in California, Florida, Illinois, Michigan, New Jersey, New York, and Washington, who complained that Apple knew of and concealed the fact that its 2015 and later MacBook, MacBook Air, and MacBook Pro machines were equipped with "butterfly" keyboards that were prone to failure, and that its repair program for the keyboard was insufficient, as the replacement keyboards could also fail. [...]

Apple initially agreed to the settlement in July 2022. Customers in the above-mentioned states are expected to receive maximum payouts of $395 to customers who replaced multiple keyboards, $125 to people who replaced one keyboard, and $50 to people who replaced keycaps. Mac owners who received butterfly keyboard replacements will begin receiving class notices later in December.

'The Arc Browser is the Chrome Replacement I've Been Waiting For' (theverge.com) 98

The Browser Company's Chromium-based Arc browser "isn't perfect, and it takes some getting used to," writes the Verge. "But it's full of big new ideas about how we should interact with the web — and it's right about most of them." Arc wants to be the web's operating system. So it built a bunch of tools that make it easier to control apps and content, turned tabs and bookmarks into something more like an app launcher, and built a few platform-wide apps of its own. The app is much more opinionated and much more complicated than your average browser with its row of same-y tabs at the top of the screen. Another way to think about it is that Arc treats the web the way TikTok treats video: not as a fixed thing for you to consume but as a set of endlessly remixable components for you to pull apart, play with, and use to create something of your own. Want something to look better or have an idea for what to do with it? Go for it.

This is a fun moment in the web browser industry. After more than a decade of total Chrome dominance, users are looking elsewhere for more features, more privacy, and better UI. Vivaldi has some really clever features; SigmaOS is also betting on browsers as operating systems; Brave has smart ideas about privacy; even Edge and Firefox are getting better fast. But Arc is the biggest swing of them all: an attempt to not just improve the browser but reinvent it entirely....

Right now, Arc is only available for the Mac, but the company has said it's also working on Windows and mobile versions, both due next year. It's still in a waitlisted beta and is still very much a beta app, with some basic features missing, other features still in flux, and a few deeply annoying bugs. But Arc's big ideas are the right ones. I don't know if The Browser Company is poised to take on giants and win the next generation of the browser wars, but I'd bet that the future of browsers looks a lot like Arc....

In a way, Arc is more like ChromeOS than Chrome. It tries to expand the browser to become the only app you need because, in a world where all your apps are web apps and all your files are URLs, who really needs more than a browser?

The article describes Arc as a power user tool with vertical sidebar combining bookmarks, tabs, and apps. (And sets of these can apparently be combined into different "spaces".) These are enhanced with a hefty set of keyboard shortcuts (including tab searching), along with built-in media controls for Twitch/Spotify/Google Meet (as well as a picture-in-picture mode).
BR. Arc even has a shareable, collaborative whiteboard app "Easel". And it also offers powerful features like the ability to rewrite how your browser displays any site's CSS. ("I have one that removes the Trending sidebar from Twitter and another that cleans up my Gmail page.")

VMware Fusion 13 Now Available With Native Support For Apple Silicon Macs (macrumors.com) 19

VMware today announced the launch of Fusion 13, the latest major update to the Fusion virtualization software. MacRumors reports: For those unfamiliar with Fusion, it is designed to allow Mac users to operate virtual machines to run non-macOS operating systems like Windows 11. Fusion 13 Pro and Fusion 13 Player are compatible with both Intel Macs and Apple silicon Macs equipped with M-series chips, offering native support. VMware has been testing Apple silicon support for several months now ahead of the launch of the latest version of Fusion.

With Fusion 13, Intel and Apple silicon Mac users can access Windows 11 virtual machines. Intel Macs offer full support for Windows 11, while on Apple silicon, VMware says there is a first round of features for Windows 11 on Arm. Users who need to run traditional win32 and x64 apps can do so through built-in emulation. Fusion 13 also includes a TPM 2.0 virtual device that can be added to any VM, storing contents in an encrypted section of the virtual machine files and offering hardware-tpm functionality parity. To support this feature, Fusion 13 uses a fast encryption type that encrypts only the parts of the VM necessary to support the TPM device for performance and security. The software supports OpenGL 4.3 in Windows and Linux VMs on Intel and in Linux VMs on Apple silicon.

Nearly 50% of macOS Malware Comes From One App (neowin.net) 74

joshuark writes: Yikes, gadzooks, and shiver my timbers! Elastic Labs has found surprisingly that 50% of malware comes from one app: MacKeeper, ironically. Ironic in that MacKeeper claims to "keep your Mac clean and safe with zero effort." MacKeeper also has a tainted reputation for being difficult to completely uninstall and as a malicious antivirus.

A new spin on the biblical phrase, "Am I my brother's keeper..." Well, when the inmate is running the asylum.
The findings appear in Elastic Security Labs' recently released 2022 Global Threat Report. As Neowin reports, MacKeeper "can be abused by threat actors because it has extensive permissions and access to processes and files."

With that said, the report found that only 6.2% of malware ends up on macOS devices, compared to 54.4% and 39.4% on Windows and Linux, respectively.

Google Rolls Out New Features Across Maps, Search and Shopping (techcrunch.com) 25

Google announced today that it's introducing a slew of new Maps, Search and Shopping features. The company revealed a majority of the new features during its Search On event in September and is now starting to roll them out to users. TechCrunch reports: Search
Starting today, users will be able to use Search to find their favorite dish at a restaurant near them. For example, you can search "truffle mac and cheese near me" to see which nearby restaurants carry the dish on their menu. Once you find a specific dish that you're looking for, you can get more information about its price, ingredients and more. Another new Search functionality lets you use Google's multisearch feature to find specific food near you. Say you see something tasty-looking online, but don't know what it is or where to find it. You can now use Lens in the Google app for Android or iOS to snap a picture or take a screenshot of a dish and add the words "near me" to find a place that sells it nearby. Later this year, Google is going roll out an update to its Lens AR Translate capabilities so users can more seamlessly translate text on complex backgrounds. Instead of covering up the original text like it currently does, Google is going to erase the text and re-create the pixels underneath with an AI-generated background, and then overlay the translated text on top of the image.

As for the new Maps features, Google is launching a new visual search experience called Live View in London, Los Angeles, New York, Paris, San Francisco and Tokyo. Apple Plans To Source Chips From Arizona Plant In 2024 (cnbc.com) 39

Apple will buy some of its chips from a factory in Arizona, Apple CEO Tim Cook said last month at an internal company meeting in Germany, according to Bloomberg News. CNBC reports: Apple currently sources all of its processors from factories in Taiwan. It designs its own chips and Taiwan Semiconductor Manufacturing Company manufactures the A-series and M-series processors that power iPhones and Mac computers. If Apple were to buy processors manufactured in the U.S., it would represent a significant diversification in Apple's supply chain away from Taiwan.

"We've already made a decision to be buying out of a plant in Arizona, and this plant in Arizona starts up in '24, so we've got about two years ahead of us on that one, maybe a little less," Cook said, according to Bloomberg. TSMC previously announced plans for a single factory in Arizona to open in 2024 focusing on chips that use the latest manufacturing technology. TSMC said earlier this month that it is planning a second chip factory in Arizona because of "strong customer demand."

Epic Strikes Back At Apple's iOS 'Security' Defense In Appeals Court (arstechnica.com) 98

An anonymous reader quotes a report from Ars Technica: It has been over a year now since a US District Court ruled that Apple did not violate antitrust law by forcing iOS developers (like plaintiff and Fortnite-maker Epic Games) to use its App Store and in-app payments systems. But that doesn't mean the case is settled, as both sides demonstrated Monday during oral arguments in front of the 9th Circuit Court of Appeals. The hearing was full of arcane discussion of legal standards and procedures for reviewing the case and its precedents, as well as input from state and federal governments on how the relevant laws should be interpreted. In the end, though, the core arguments before the appeals court once again centered on issues of walled gardens, user lock-in, and security versus openness in platform design.

In defending Apple's position, counsel Mark Perry argued that the company's restraints on iOS app distribution were put in place from the beginning to protect iPhone users. Based on its experience managing software security and privacy on Macs, Apple decided it "did not want the phone to be like a computer. Computers are buggy, they crash, they have problems. They wanted the phone to be better." If the Mac App Store was the equivalent of a lap belt, the iOS App Store, with its costly human review system, is "a six-point racing harness," Perry said. "It's safer. They're both safe, but it's safer." While Epic argued that the iPhone's walled garden "only keeps out competition," Perry shot back that "what's kept out by walled gardens is fraudsters and pornsters and hackers and malware and spyware and foreign governments..." Providing superior user safety, Perry said, is a key "non-price feature" that helps set the iPhone apart from its Android-based competition. Users who want the more open system that Epic is fighting for can already buy an Android phone and choose from a variety of App Stores, Perry said. By doing so, though, those users "open themselves up to more intrusion" compared to an iPhone, he argued. Those kinds of "pro-competitive" security features Apple offers with its App Store restrictions legally outweigh the "minor anti-competitive effects" iOS app developers face on the platform, Perry said.

[...] Apple's Perry argued that Epic presented "no data or empirical evidence" to show that users felt locked in to Apple's app ecosystem. Epic failed to commission the usual survey that would show users were worried about switching costs or information costs in a case like this, Perry said, a "failure of proof" that he said obviates all other technical legal claims. At the same time, Perry said Epic carefully "crafted a market definition only fitting Google and Apple" in arguing its case and has not been able to bring in other developers to support a class action. Epic "didn't want to pick a fight with the consoles, didn't want to pick a fight with Microsoft," he said, despite similarities in the "walled garden" approaches in those markets. The three-judge appeals panel betrayed little as to which arguments it favored during Monday's hearing, offering pointed questions for both sides. A ruling in the appeals case is expected sometime next year.
