Most mortgage companies now offer 40 or even 50 year mortgages (and have, at least in the case of 40 year programs, for years), so its unlikely this bug will effect many lenders. Probably just smaller brokers, if even them.
From a perspective of how I imagine dates are handled, (if date = thisdate) I don't think the y2k38 bug should have any effect on setting a future date. The whole idea of the y2k38 is that the 32bit integer is going to overflow, but even if they did store that future date as a tick count integer it shouldn't actually cause any ill effects until said future date rolls around.
